However, if you are the subject of a background screening, you will need to also agree to the Company’s separate disclosures and authorizations that will be provided to you during the screening process.

By using the Website, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found here, incorporated herein by reference. SPECIAL NOTICE REGARDING THE WEBSITE TERMS OF USE: Collection, Use and Disclosure of Your Personal Data When Done for Purposes of a Consumer Report

The Company is a Consumer Reporting Agency (CRA) that conducts background screening, including the preparation of “Consumer Reports” (as defined by the Fair Credit Reporting Act), for its authorized end-user clients under the provisions of the federal Fair Credit Reporting Act, state law equivalents, and international laws and regulations where applicable. When done for purposes of preparing a Consumer Report, the Company only collects personal data pursuant to written disclosure and authorization under the FCRA and other applicable laws, and only disseminates Consumer Reports to its clients as directed and when permitted by applicable law.

If you are the subject of a background screening, the Company’s separate disclosures and authorizations that will be provided to you during the screening process by your potential employer or other authorized end-user which will control the provision and dissemination of certain information about you over general privacy policy statements contained herein that pertain to all users of the website.

If you are undergoing a background screening with the Company, the background screening will involve verifying personal data that you have provided during the application process and the collection of additional information about you. Each end-user client applies their own background screening criteria, and Company only processes the services we are instructed to perform by the end-user client. Depending on the scope of inquiries requested by the end-user client the background check may in whole or in part include, obtain, and/or verify: your criminal history; employment history (to include dates of employment, my job title/position, and reason for leaving); social security number information; drug screen; education; academic and professional credentials; financial responsibility; driving records including Motor Vehicle Records (permitted by 18 US Code 2721 (b)(6)(9)(13)(14)); and previous background screenings. The Company may further collect any other information as authorized by you. The information collected may be compiled in a Consumer Report where permitted by applicable law. The requesting end-user may use the Consumer Report to evaluate an applicant for the open position. This evaluation is necessary for the requesting end-user to determine whether to enter into an employment or contracted work agreement with you and for the requesting end-user to pursue its legitimate interests of ensuring the fidelity of its workforce.

The requesting end-user will not disclose the Consumer Report to any unaffiliated third party except in exceptional circumstances, such as to seek advice from its professional advisors or to defend legal claims. Your information is retained by the Company for a minimum of six (6) years unless otherwise restricted by applicable laws and regulations.

Accessing the Website and Account Security

We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. Governing Law and Jurisdiction

All matters relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule (whether of the State of Texas or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Arbitration

To the extent you are undergoing the Company’s background screening, any dispute arising in whole or in part out of the Terms of Use or Privacy Policy will also be subject to the “Applicant Arbitration Agreement with the Cole Group” if agreed to during the screening process. The Applicant Arbitration Agreement with the Cole Group will control over any other term of this Agreement to the extent there is a conflict.  

Waiver and Severability

No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and The Cole Group regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.

To the extent that, previously or in the future, you enter into any written agreement with the Cole Group not specifically related to the Website, in the event of any conflict between any terms or conditions in such agreement(s) and the terms and conditions of these Terms of Use, the terms and conditions of these Terms of Use are superseded by the conflicting terms or conditions of the other written agreement(s) between you and the Company.
